CONSUMER DISCLOSURE of
Rules, Terms and Conditions

ELIGIBILITY.  NO PURCHASE NECESSARY TO ENTER.  Purchase does not increase chances of winning.  Contest open to residents of the 50 United States ages 21 and older at time of entry.  Void where prohibited by law.  All federal, state, and local laws and regulations apply.  Beginning October 1, 2011, enter one of two ways:

(1) play Jackpot Slots and achieve 50,000 credits, then enter through pop-up electronic form; or

(2) complete and mail entry form available in PDF format HERE to:

Entries must be filled out completely.  New Potato is not responsible for incomplete, lost, late, or misdirected entries, whether submitted by mail or through electronic means. New Potato is not responsible for entries that are corrupted or otherwise not received correctly or for any problems or technical malfunctions of any telephone network or lines, computer systems, servers or providers, computer equipment, software, failure of email, or on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof.  New Potato is not responsible for any injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in the sweepstakes.  Employees, officers, and directors of New Potato and its affiliates and distributors and their immediate family members living in their households are not eligible.  Anyone who fails to comply with these rules or tries in any way to tamper with or defraud a Prize Drawing will be held ineligible. 

SELECTION OF WINNERS.  (2011) Monthly drawings will occur during the first seven days of each month for as long as the contest continues.  Contest begins October 1, 2011 and will run through at least January 31, 2012.  Odds of winning depend on number of entrants, but could be 1 in 1 million.  Winners selected by random drawing.  Names of winners subject to verification by New Potato’s confirmation of entry information. Names of winners available by written request to: New Potato Technologies Inc., Attention: Sweepstakes Winners Request, 5508 Business Drive, Wilmington, North Carolina 28405.  Any dispute as to the ownership of an electronic entry may be settled by considering account holder records.  New Potato resolves all disputes over choice of winners.

PRIZES.  Monthly drawings are scheduled to occur on the last Thursday of the month during the period spanning October 1, 2011 through at least January 31, 2012. Monthly drawing prizes for at least three separate winners include merchandize or gift cards with approximate retail values of $100 USD, $75 USD, and $50 USD, respectively.

Taxes, costs, and other fees associated with each prize are the sole responsibility of the winner.  Prizes are non-transferable and cannot be exchanged for cash.  Each prize will be delivered to the winner within 10 days of selection with no delivery expense to winner. 

ADDITIONAL INFORMATION.  Contest subject to additional terms.  Contest benefits New Potato Technologies, Inc.  New Potato is its sole sponsor, is responsible for all prizes and conducting the promotion.  Apple Inc. is not a sponsor of, or responsible for conducting the promotion.  New Potato reserves the right to cancel, in its sole discretion, the contest at any time.  Entrants agree for their names and likenesses to be used in New Potato promotional materials at no cost to New Potato, its affiliates, service providers or vendors.

RELEASE OF NEW POTATO TECHNOLOGIES, INC. FROM LIABILITY. Entrants hereby release New Potato and its employees, officers, directors, affiliates, successors, and assigns from all liability for any damages, injuries, losses, or claims arising from Jackpot Slots Prize Drawing.  Winners hereby release New Potato and its employees, officers, directors, affiliates, successors, and assigns from all liability resulting from receipt, use or misuse of a prize.  Entrants and winners further agree, in the event of any third-party claims, damages, losses, or injuries arising from the contest or Prize Drawing relating to the Entrant or Winner, to release, indemnify and defend New Potato and its officers, directors, employees, affiliates, successors and assigns from all such claims, damages, losses or injuries, including associated attorneys’ fees and costs. These releases and indemnity shall be limited as necessary to comply with applicable law.

MANDATORY ARBITRATION AND CHOICE OF LAW.  By entering, you agree that any dispute or controversy relating to Jackpot Slots Prize Drawing or these provisions shall be submitted exclusively to binding arbitration in New Hanover County, North Carolina before a single arbitrator pursuant to Article 45C, G.S. 1-569.1, et seq., commonly known as the North Carolina Revised Uniform Arbitration Act in effect as of this date.  If the parties are unable to agree upon the arbitrator, then the arbitrator shall be appointed by the court (upon application of any party). The applicant, pursuant to G.S. 1-569.11, need not show the refusal of the other party to arbitrate.  Any question of arbitrability shall be determined by the arbitrator appointed by the court.  The arbitrator may award any relief to a party, including preliminary and injunctive relief, which a court sitting in the same jurisdiction could award, and no other relief.   North Carolina law shall govern in all respects, and excluding the conflicts of laws provisions thereof.

SEVERABILITY.  Should any provision hereof be deemed void or unenforceable by a court or tribunal of competent jurisdiction, the remaining provisions shall continue in full force and effect.
